Decision of the German Federal Supreme Court of August 1, 2006 - X ZR 114/03 (Appellate Court Munich) (Restschadstoffentfernung - Original in German language)

According to § 142 ZPO, the court can demand the presentation of certificates or documents in any legal action concerning technical property rights, if this would be helpful and necessary to clarify the respective case and can be expected of the person who has to present his documents. According to a recent decision of the German Federal Supreme Court, one can be ordered to present his documents even if an infringement is only possible.
